What can we expect from Rouhani’s second term? The large majority with which he won does not change the basic fact that the number one decision-maker in Iran remains Supreme Leader Khamenei. Ephraim Kam writes to Iran Matters that it is doubtful that Rouhani’s large majority will translate into greater power vis-à-vis Khamenei and the regime’s radical wing, as the president will likely continue to depend on them.

"Mr. Chairman, Ranking Member Brown and members of the committee, thank you for this opportunity to testify on the international agreement to prevent Iran from becoming a nuclear weapons power and the implications for sanctions relief.

This is one of the most urgent and important challenges for our country, for our European allies as well as for Israel and our Arab partners in the Middle East.  The United States must thwart Iran’s nuclear weapons ambitions and its determination to become the dominant military power in the region."

Elements of the Iran Nuclear Deal

The July 14, 2015 comprehensive nuclear deal between Iran and the P5+1 (known as the Joint Comprehensive Plan of Action or JCPOA) consists of the agreement itself and five technical annexes: Annex I – Nuclear-related measures; Annex 2 – Sanctions-related commitments; Annex III- Civil Nuclear Cooperation; Annex IV – Joint Commission; and Annex V – Implementation Plan. The version issued by the EU is used here because pages and paragraphs are numbered in proper order.

This article describes the main elements of the JCPOA. In coming days, the Belfer Center plans to publish a more detailed description and assessment of the agreement.

Inside the Nuclear Weapon Free Iran Act of 2013

News broke yesterday that three prominent senators—Menendez (D-NJ), Kirk (R-IL), and Schumer (D-NY)—may introduce legislation this year that would impose new sanctions against Iran with a “deferred trigger.” That is, the new sanctions can be averted only if the Obama administration provides specific and difficult certifications every 30 days including that Iran is implementing the terms of the November 24 Joint Plan of Action and negotiating “in good faith” toward a final deal. Based on an advance copy of the “Nuclear Weapon Free Iran Act of 2013,” I summarize the substance of the draft legislation, including both the new proposed sanctions and the complicated set of presidential certifications and notifications to waive existing sanctions and suspend the additional sanctions.  In a second post, I examine the current legislative state of play and the likely administration objections to the draft legislation.

Anticipating objections to the Nuclear Weapon Free Iran Act

In the near term, the Obama administration does not yet need to engage Senators Menendez, Kirk, and Schumer on the details of their proposed Nuclear Weapon Free Act of 2013. The upcoming congressional recess and the protection of friendly senators (including Senate Majority Leader Harry Reid and Chairman of the Senate Banking and Finance Committee Tim Johnson) are likely to delay consideration of the bill for the time being. However, congressional support for sanctions legislation against Iran has strong bipartisan support, and pressure for additional legislation is likely to grow if – as seems likely – it becomes apparent in coming months that negotiations between the P5+1 and Iran on a final agreement are not faring well. In the event that the Obama administration is forced to enter into negotiations with Congress on new sanctions legislation, the White House is likely to have several objections to the proposed Senate legislation, especially on the certification requirements to waive or suspend sanctions.

Despite the longstanding and ever-evolving "special relationship" between the United States and Israel, the two allies do not appear to have engaged in substantive discussions on key facets of their most pressing mutual concern, the Iranian nuclear threat. Specifically, there has been little if any dialogue on the possibility of military action if the diplomatic route comes to a dead end, nor on the possible means of living with a nuclear Iran should both countries decide to refrain from military action.
